1. APPLICATION OF TERMS

1.1 Yuno is a reward website that connects you to surveys about various topics. You earn points when you complete surveys and you can request that your points are exchanged for rewards such as gift vouchers. These Terms of Use (Terms) apply to your use of the Yuno website (hereinafter "Website", as defined below). By accessing and using the Website:
a. You agree to these Terms; and
b. You confirm that you:
(i) are 16 years of age or older;
(ii) are accessing Yuno on your own behalf and for your own personal use - you understand and acknowledge that companies and businesses are prohibited from creating user accounts;
(iii) will not create multiple user accounts or logins - you understand and acknowledge that only one user account per person is allowed.
1.2 If you do not agree to these Terms, you are not authorised to access and use the Website and you must immediately stop doing so.

2. CHANGES

2.1 We may change these Terms at any time by updating them on the Website. Unless stated otherwise, any change takes effect immediately. You are responsible for ensuring you are familiar with the latest Terms. By continuing to access and use the Website, you agree to be bound by the latest Terms, including changes as applicable.

2.2 We may change, suspend, discontinue, or restrict access to, the Website without notice or liability at any time and at our discretion.

3. DEFINITIONS

In these terms:

including and similar words do not imply any limit.

Intellectual Property Rights includes copyright and all rights existing anywhere in the world, whether registered or unregistered, or conferred under statute, common law or equity relating to inventions (including patents), registered and unregistered trademarks and designs, data and databases, confidential information, know-how, and all other rights resulting from intellectual activity. Intellectual Property includes any enhancement, modification or derivative work of the Intellectual Property.

Loss includes loss of profits, savings, revenue or data, and any other claim, damage, loss, liability and cost, including legal costs.

Terms means these terms titled "Yuno Terms of Use", as updated from time to time.

Underlying Systems means any network, system, software, data or material that underlies or is connected to the Website.

User ID means an identifier including a unique name (your email address) and/or phone number and password allocated to you to allow your access to, and use of, the Website.

Website means yunosurveys.com, and includes the services accessible via this site.

Words in the singular include the plural and vice versa.

4. YOUR OBLIGATIONS

4.1 You must provide true, current and complete information in your dealings with us and our partners or advertisers (including when setting up an account), and you must promptly update that information as required so that the information remains true, current and complete.

4.2 You must keep your User ID secure and:
a. Not permit any other person to use your User ID, nor disclose or provide your User ID to any other person; and
b. Immediately notify us if you become aware of any disclosure or unauthorised use of your account or User ID, by sending us an email to [contact@yunosurveys.com].

4.3 You must:
a. Not act in a way, or use or introduce anything (including any virus, or malicious software or programme) that in any way compromises, or may compromise the Website or any Underlying System, or otherwise attempt to damage or interfere with the Website or any Underlying System; and
b. Not use the Website in connection with fraudulent, abusive, or illegal activity, including but not limited to device ID manipulation, misrepresentation of offer eligibility (including deceptive geolocation manipulations like the use of a proxy server or a VPN), interference with our services or systems (automation, use of bots or spiders, deep linking, spam, viruses and other malware, or any other material which is malicious or technologically harmful) or attempts to decompile or reverse engineer our code (other than as permitted by law).
c. Not attempt to gain unauthorized access to any part of our Website, the server on which our Website is stored, or any other server, computer, or database connected to our Website. You must not attack our Website by means of a denial of service attack, a distributed denial of service attack, or by any other means.
d. Not exploit, distribute, or publicly inform other users of any error, miscue, or bug that gives an unintended advantage; violate any applicable laws or regulations; promote or encourage any illegal activity.

4.4 We make the Website services available to you to use for your personal benefit; you may not use the Website for commercial purposes or financial gain. For example, you are not allowed to sell or rent our Website services to a third party or otherwise exploit our Website for the economic benefit of a third party (click farms and similar).

4.5 You indemnify us against all Loss we suffer or incur as a direct or indirect result of your failure to comply with these Terms, including any failure of a person who accesses and uses our Website by using your User ID.

5. INTELLECTUAL PROPERTY

We (and our licensors) own all proprietary and Intellectual Property rights in the Website (including all information, domain names, data, text, statistical data, analytical data, graphics, artwork, photographs, logos, icons, sound recordings, videos and the Website look and feel) and the Underlying Systems. You agree not to contest or dispute that ownership, or the validity of those Intellectual Property Rights.

6. DISCLAIMERS

6.1 The Website is provided "AS IS" and "AS AVAILABLE", with no warranties whatsoever. To the extent permitted by law, we and our licensors have no liability or responsibility to you or to any other person for any Loss in connection with:
a. The Website being unavailable (in whole or in part) or performing slowly;
b. Any error in, or omission from, any information made available through the Website;
c. Any exposure to viruses or other forms of interference which may damage your computer system or device or expose you to fraud when you access or use the Website. To avoid doubt, you are responsible for ensuring the process by which you access and use the Website protects you from this; and
d. Any site linked from the Website. Any link on the Website to other sites does not imply any endorsements, approval or recommendation of, or responsibility for, those sites or their contents, operations, products or operators.

6.2 You are responsible for ensuring that your access to and use of the Website is not illegal or prohibited, and for your own compliance with applicable and local laws. We make no representation or warranty that the Website is appropriate or available for use in certain countries or locations (including your country/location) or that the content satisfies applicable laws. Some functions of the Website may be available in certain countries or locations only. The availability of the Website may be expanded from time to time. However, we make no guarantees of future availability in additional countries or locations.

7. REWARDS

7.1 You earn points by completing certain actions (e.g. responding to surveys) on the Website. Points have no cash value but they may be redeemable for rewards. In order to redeem rewards you can submit a request for reward on the Website once you have earned sufficient points.

7.2 NO GUARANTEE OF REWARDS. You acknowledge and agree that reward requests are accepted or declined solely at our discretion. You have no right or claim to a reward, and no reward shall be issued unless we accept your request for a reward. We will not accept requested rewards if we suspect fraudulent activity or any activity that is otherwise not in compliance with these Terms. In the event that you believe a declined reward request should have been accepted, you can contact us at contact@yunosurveys.com and we will look into it.

7.3 If we accept your request for a reward, you will receive a confirmation from us. Your reward will then be processed by our third party rewards partner, who will contact you via email to issue you with the reward. We do not issue rewards. The issuing of rewards is subject to the third party service provider’s terms and conditions.

8. LIABILITY

8.1 To the maximum extent permitted by law:
a. You access and use the Website at your own risk; and
b. We are not liable or responsible to you or any other person for any Loss under or in connection with these Terms, the Website, or your access and use of (or inability to access or use) the Website).

8.2 Except to the extent permitted by law, nothing in these Terms has the effect of contracting out of applicable consumer protection law that cannot be excluded. To the extent that our liability cannot be excluded but can be limited, out liability is limited to €50 (fifty Euros).

8.3 To the maximum extent permitted by law and only to the extent clauses 8.1 and 8.2 above do not apply, our total liability to you under or in connection with these Terms, or in connection with the Website, or your access and use of (or inability to access and use the Website), shall not exceed €50 (fifty Euros).

9. PRIVACY POLICY & DATA USE

9.1 We collect, handle and store personal data in accordance with our Privacy Policy. By accessing and using the Website, you acknowledge and agree to the terms in our Privacy Policy.

9.2 You acknowledge and agree that by accessing and using the Website, including sign up, completion of the profiling questionnaire and responding to surveys, the information you provide us with may be used by us for business purposes. Such use may include the sharing of the information with our third party partners. We will always handle your personal information in accordance with our Privacy Policy.

10. SUSPENSION AND TERMINATION

10.1 Without prejudice to any other right or remedy available to us, if we consider that you have breached these Terms or we otherwise consider it appropriate, we may immediately, and without notice, suspend or terminate your access to the Website (or any part of it). In the event that you believe a suspension or termination of your account should not have occured, you can contact us at contact@yunosurveys.com and we will look into it.

10.2 On suspension or termination, you must immediately cease using the Website and must not attempt to gain further access.

11. GENERAL

11.1 If we need to contact you, we may do so by email or by posting a notice on the Website. You agree that this satisfies all legal requirements in relation to written communications.

11.2 These Terms, and any dispute relating to these Terms or the Website, are governed by and must be interpreted in accordance with the laws of the Federal Republic of Germany.

11.3 For us to waive a right under these Terms, the waiver must be in writing.

11.4 Clauses which, by their nature, are intended to survive termination of these Terms, including clauses 4.5, 5, 6, 8, 11.1 continue in force.

11.5 If any part or provision of these Terms is or becomes illegal, unenforceable, or invalid, that part or provision is deemed to be modified to the extent required to remedy the illegality, unenforceability, or invalidity. If a modification is not possible, the part or provision must be treated for all purposes as severed from these Terms. The remainder of these Terms will be binding on you.

11.6 These Terms set out everything agreed by the parties relating to your use of the Website and supersede and cancel anything discussed, exchanged or agreed prior to you agreeing to these Terms. The parties have not relied on any representation, warranty or agreement relating to the Website that is not expressly set out in the Terms, and no such representation, warranty or agreement has any effect from the date you agreed to these Terms.
